  Yes, anyone from any foreign country can acquire an immovable property on the Tunisian territory, and that can be done on the condition of establishing a demand to obtain the authorization of the Governor of the zone from where the good will be acquired..







  The real estate acquisition in Tunisia is made in several stages: signature of the sales agreement, the deposit of the file with the governor (for a foreign buyer), signature of the final act of sale and delivery of the title deed. Besides, the real estate purchase in Tunisia requires the intervention of a lawyer .All these stages will be parts of the contract carried out with a lawyer which will manage the file in its totality.

GENERALITIES

   Foreign persons: For foreign persons, an administrative authorization called " the Governor's Authorization» must be made in the Governorate (territorial collectivity) of the region where the good exists.

- This authorization is also compulsory in case of resale.
- Every foreign person can acquire an immovable property on the condition of obtaining this authorization.

REGULATIONS 

   The Agricultural Grounds cannot be sold to foreigners no matter what is the motive for purchase. Foreigners cannot exploit a farmland even only by means of the rent. If the ground is in the development plan of cities' urbanism, it is for usage of habitation, while, if that same ground does not make part of this development plan, it is agricultural and it is thus impossible for a foreigner to acquire.

PROCEDURE

The foreign buyer is obliged to conclude a sales agreement, a compromise which mentions: all about the immovable property, its price, the advance pricing and all information concerning the identities of both the salesman and the buyer.

- This promise is essential to the deposit of the file, it is necessarily drafted by a lawyer or a solicitor. This document is a proof of payment of the deposit.

- An article of this promise has to plan a clause which allows recovering a part or the entire sum paid during the sales agreement in case of refusal of the Governor.

- The salesman makes a commitment in the sales agreement not to sell his immovable property to another buyer as long as he is not authorized to do it, he is thus going to lose opportunities of sale and so he can ask to keep a defined sum on the deposit.

- This allowance must be fixed during the drafting of the sales agreement; it is generally 10 % of the paid sum.

- No legislation exists about the advance to be paid during the sales agreement, this amount is to be discussed, and oscillates generally between 10 and 30 %.

- Any foreigner has to ask the Bank which will pay the deposit, an index card which will allow repatriating the investment in case of resale.

The sales agreement is thus a very important element, it is important to ask advice to the writer.
